Terms of Service
These terms govern your use of Nyumbisha, a rent and property management service provided by Astralyn (“we”, “us”). By creating an account or using Nyumbisha, you agree to them. If you use Nyumbisha for a business, you accept these terms on its behalf.
We are reviewing these terms with our lawyers and will publish any changes on this page.
1. The service
Nyumbisha helps landlords and managing agents in Kenya keep property and tenancy records, bill tenants, send reminders and receipts over WhatsApp and SMS, request payments by M-Pesa and match the payments they receive. Some features depend on third parties such as Meta (WhatsApp) and Safaricom (M-Pesa), and work only while those services do.
2. Your account
- You must give accurate details and keep your phone and sign-in secure.
- You are responsible for what happens under your account, including by team members you invite.
- Tell us straight away if you think someone has used your account without permission.
3. Plans and payment
- The Free plan is free, for ever, at any size.
- Paid plans are billed monthly or yearly, in advance, by M-Pesa. A yearly plan is charged at ten months’ price for twelve months. Current prices are on our pricing page.
- There is no setup fee and no minimum term. You can change plan or stop at any time.
- If a payment is not made, your account moves to the Free plan after 14 days. Your records stay as they are, and paid features return when you pay.
- We may change prices. We will tell you before a change applies to you, and it will not affect a period you have already paid for.
4. Rent and money
Rent your tenants pay through Nyumbisha goes directly to your own M-Pesa or bank account. We never hold, receive or control rent money, and we are not a party to your tenancy agreements. You remain responsible for your tenancies, for the amounts you charge, and for resolving disputes with your tenants.
5. Your data and your tenants’ data
- Your records are yours. You can export them at any time, on every plan, including after you stop paying.
- You are responsible for having a lawful basis to record your tenants’ details and to contact them through Nyumbisha, and for keeping those records accurate.
- We process personal data as described in our Privacy Policy.
6. Acceptable use
You agree not to use Nyumbisha to:
- break the law, including the Data Protection Act, 2019 and landlord and tenant law;
- harass, threaten or send unwanted messages to anyone;
- upload data you have no right to use;
- interfere with the service, or try to access accounts or data that are not yours.
We may suspend accounts that break these rules, and will tell you why where we can.
7. Availability and changes
We work to keep Nyumbisha available and reliable, but we cannot promise it will always be uninterrupted or error-free. We may improve, change or remove features; if we remove something you pay for, we will tell you in advance.
8. Liability
To the extent the law allows, we are not liable for indirect or consequential losses, or for losses caused by third-party services such as WhatsApp, SMS networks or M-Pesa. Our total liability to you is limited to the fees you paid us in the twelve months before the claim. Nothing in these terms limits any liability that cannot be limited by law.
9. Ending your use
You can stop using Nyumbisha at any time. We may end or suspend your access if you seriously or repeatedly break these terms. Either way, you can export your records first.
10. Law and disputes
These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction. Before going to court, we will both try to resolve any dispute by talking it through.
11. Changes to these terms
We will post changes here and update the date at the top. If a change is significant, we will tell account holders before it applies. Using Nyumbisha after a change takes effect means you accept it.
